World Data Protection Day: in the eyes of Islam

Every year on this day, various campaigns are launched around the world to create awareness about the need for protection of personal information. Convention 108 is the first international treaty on the protection of privacy and information that has a legal obligation to comply. The day is celebrated annually on January 28 in the United States under the auspices of the National Cyber ​​Security Alliance (NCSA). Celebrated in Europe, Data Protection Day has been celebrated in North America since 2008. This day is primarily an opportunity for businesses and private consumers to share the best techniques for protecting personal information. Data Privacy Day is part of a larger global campaign to raise awareness of the need for privacy. Highlights all the easy ways to protect personal information. Organizations are also reminded that privacy is important in all matters. The Cyber ​​Crime Awareness Foundation has joined the growing global campaign to create awareness at home and in the workplace at the level of non-profit organizations, educational institutions, corporations, government agencies, municipalities and individuals. All ‘Data Privacy Day Champion’ promotes a consistent message about privacy and personal data protection through collaboration and coordination. Through this, the organizations are working to achieve the general goal of developing personal and business awareness in establishing information security and trust. At present, the number of Internet users in Bangladesh, according to the BTRC report, the number of Internet users in the country has increased by 34 lakh 25 thousand in one month. And the number of mobile connections has increased to 12 lakh 73 thousandAccording to the report, at the end of March 2021, the total number of Internet users in the country stood at 11 crore 61 lakh 40 thousand. In February this number was 11 crore 27 lakh 15 thousand. The number of internet users has increased by 34 lakh 25 thousand in one month. Of these, the number of mobile internet users is 10 crore 63 lakh 30 thousand. On the other hand, the number of broadband (ISP and PSTN) internet subscribers has also increased. The number of broadband subscribers is in the millions. At the end of March, this number stood at 98 lakh 10 thousand. At the end of February which was 95 lakh 22 thousand. Today we spend most of our lives on the Internet and devices connected to us. Very few people still know that a lot of personal information is being collected and shared from the devices and online services we use. This information may be stored indefinitely and may be used to our personal advantage and may be used unnecessarily. It has even been observed that it is a result of sharing unsolicited information online Used to interfere with your socioeconomic position. Such as sharing your favorite restaurants or items you`ve purchased online. And in the absence of strong legal issues, many domestic and foreign companies are getting the opportunity to monitor the personal behavior of their users and buyers and they are selling this information to the consumers for profit. Consumers need to understand the true value of their information and how this information is being collected, used and shared. They also need to know how to manage their personal information well. Article 43 (b) of the Constitution of Bangladesh recognizes the right to privacy as a fundamental human right. At the same time, Section 63 of the Information and Communication Technology Act has made it a crime to disclose personal information without permission. The Universal Declaration of Human Rights (Article 12), the International Covenant on Civil and Political Rights (Article 17), the United Nations Convention on Migrant Workers (Article 14) and the Convention on the Rights of the Child (Article 16) define privacy as a right. However, there is no clear guideline in any law of Bangladesh regarding the protection of citizen`s information. Now is the time to enact information protection lawsIt is important to ensure that the individual has maximum control over the collection, storage, processing, dissemination and application of personal information by public and private organizations. And in Bangladesh, as in many other countries, it is important to have legal measures in place to prevent extreme moral crimes, such as violations of human privacy. There should be strict laws so that no one can infringe on the rights of another citizen if he wants to. The law is responsible for protecting the rights of the individual. At the same time, public awareness is needed to comply with the law. This misdeed cannot be stopped by law alone. When people are aware of moral values, it is possible to control extreme moral crimes, such as violating personal privacyIn the eyes of Islam, it has imposed restrictions on the disclosure of personal information of the people. Protecting personal privacy is considered as protecting the deposit of the person concerned. If the faults of another Muslim brother are observed in the eyes of a Muslim brother, then the duty is to conceal the faults, not to humiliate or insult him by revealing him in public. The clear view of Islam in this regard is that the Prophet (peace and blessings of Allaah be upon him) narrated from Abu Hurairah He said, "One believer is the mirror and brother of another believer." (Abu Dawood, Hadith-4918) Islam`s approach to protecting privacy is very important and realistic. In the Holy Quran, Allah says, ‘O you who believe! Surely some ideas are sinful and do not look for secrets. Let none of you slander anyone. Would any of you like to eat the flesh of your dead brother? In fact, you hate it. Fear God. Surely Allah is the Acceptor of Repentance, the Most Merciful. `(Surah Hujrat, verse 12) 1. Strong ideas (evil intentions, evil thoughts); 2. Finding someone`s secret faults and 3, backbiting. These three things are clearly forbidden in Islam.

In the first part of the verse, the Prophet (peace and blessings of Allaah be upon him) said: “None of you should die without having a good idea of ​​Allaah.” I treat the slave as if he had an idea of ​​me. Now let him have whatever idea he wants towards me. ` In this way, it is haraam for Muslims to have a bad opinion without any evidence about those who appear to be virtuous in their outward appearance. The Prophet (peace and blessings of Allaah be upon him) said, ‘Stay away from ideas. Because, the idea is the name of a lie. `(Sahih Bukhari-4066, Muslim-2563)

The second taboo subject discussed in the verse is to look for someone`s fault, which we understand as `personal privacy`. Disclosure of personal privacy leads to various fitna-fasads. That is why the Prophet (peace and blessings of Allaah be upon him) once said about those who seek fault in his sermon, ‘O you who have believed in the mouth but the faith has not yet entered your heart, do not seek the‘ secrets ’of the Muslims. That The person will go around looking for the faults of the Muslims and Allah will start looking for his faults. And Allah will humiliate the one whom he seeks in his house. `(Sunan Abu Dawood-4880) It will bring disaster for them or at least bring them to the brink of disaster. `(Sunan Abu Dawood-4888) For, whoever seeks the faults of the Muslims, Allah seeks his faults. Whoever seeks fault, Allah will humiliate him in his own house. ` In this case, this incident of Umar is very instructive. One night he heard a man`s voice. She was singing. His suspicion. He said to his companion Abdur Rahman Ibn Awf, "Whose house is this?" They are drinking now. What do you think? Then Abdur Rahman Ibn Awf said, "My opinion is that we are doing what Allah has forbidden." Allah Ta`ala forbids us to do that, "Do not seek secrets." (Surat al-Hujurat, verse 12) Then `Umar returned and left him. (Mustadrake Hakim-8249, Makarimul Akhlaq: Abu Bakr Muhammad Ibn Jafar Al Kharaiti-398, 420, Musannafe Abdir Razzaq-10/221) Not only for the individual, but also for the Islamic government. This has also been mentioned in a hadith. In that hadith, the Prophet (peace and blessings of Allaah be upon him) said, ‘When the rulers start searching for the faults of the people out of suspicion, it destroys their character.’ (Sunan Abu Dawood -4889). Because a lot of information spread in the society is baseless. Allaah says (interpretation of the meaning): “And when they heard it, why did the believing men and believing women not think well of their people and say, `This is a blatant blasphemy.`” (Surah Noor, verse 12).
