  Property owned by Jatrabari Fish Market occupied by DSCC while the case pending

News Desk: After evicting Jatrabari Dhaka Bazar Fish Market, the property department of Dhaka South City Corporation (DSCC) is now constructing the boundary wall. Dhaka South City Corporation Property Officer and Executive Magistrate Md Moniruzzaman and Senior Assistant Secretary Executive Magistrate AH Irfan Uddin Ahmed conducted the eviction drive on Saturday afternoon. On Sunday, he built a boundary wall at that place.

According to court sources, the now defunct Dhaka South City Corporation has directed the Dhaka Deputy Commissioner to acquire 5 acres of land for the construction of the market and raw material market. Deputy Commissioner Jatrabari Mouza acquired 5 acres and 21 per cent land on the basis of RS Dag No. 2357. Humayun Kabir, the owner of RS Dag No. 2357, refused to give him 6 per cent of the land as he had acquired more land than required. He filed a case against the concerned in the High Court Division of the Supreme Court. The case is currently pending in the Appellate Division, whose Appeal No. 6995/2018. While the case was pending in the Supreme Court, the DSCC seized the fish market by demolishing the privately owned property.

Meanwhile, Anwar Kabir Bhuiyan claimed to be the owner of the evicted land and said, "I am the owner of the evicted and occupied land." A tinshed building has been constructed in my place and 20 shops have been set up. The market has been named Jatrabari Dhaka Bazar Fish Market. Traders have been doing fish business there for a long time. A case is pending in the Supreme Court with the Dhaka South City Corporation over the property.

Dhaka South City Corporation Property Department Officer and Executive Magistrate Md. Moniruzzaman and Executive Magistrate AH Irfan Uddin Ahmed without any prior notice and without showing any paperwork for the eviction operation, on Saturday at noon on the day of official closure, 20 shops were demolished by bulldozers. During this time, I have repeatedly requested him to tell me that there is a case pending in the High Court regarding this property and there is a stay order. I showed them the court order documents. None of my words mattered. Ignoring the court order, he conducted the eviction campaign without caring about me. I have lost about one crore rupees. They did not stop the eviction campaign. He evicted on Saturday and occupied the place on Sunday and built a boundary wall. He said that he was continuing to take up the matter of taking possession of the property in defiance of the court order before the Supreme Court.

Advocate Abdul Hai, the Supreme Court`s lawyer in the case, said the case was pending and adjourned in the high court. There, Dhaka South City Corporation disobeyed the order and carried out eviction campaign without giving any notice and caused huge loss to the land owner. Later he built the boundary wall again, which amounts to contempt of court.

In this regard, Dhaka South City Corporation Property Department Officer and Executive Magistrate Md. Moniruzzaman said, the evicted property was acquired by Dhaka South City Corporation. There is no new order of the High Court on the property after 2018.
