Alleged violation of section 144 as house construction continues on disputed land in Shibganj
  Date : 04-11-2026

Mizanur Rahman, Chapainawabganj: An allegation has surfaced that a party involved in a long-standing land dispute has started constructing a permanent house on the disputed property in defiance of a court-imposed order under Section 144 of the Code of Criminal Procedure in Shibganj upazila of Chapainawabganj.

The incident reportedly took place on Wednesday afternoon in Bishwanathpur village under Kansat Union, raising concerns over compliance with court orders and the possibility of a deterioration in law and order.

According to police and local residents, the dispute centres on six decimals of homestead land between Abdur Razzak, son of the late Belal Uddin, and Akhtarul Islam Sumon, son of the late Joharul Islam, both residents of Bishwanathpur village. The two families have reportedly been at loggerheads over ownership and possession of the property for a long time.

On October 23, Sumon allegedly began renovation work on a house on the disputed land. Subsequently, Abdur Razzak filed a case with the court of the Additional District Magistrate in Chapainawabganj, naming two individuals and accusing another 10 to 12 unidentified people.

Following the complaint, the court issued an order under Section 144 on October 28. Shibganj Police Station subsequently served a formal notice under the same section on November 2.

However, Razzak has alleged that Sumon and his associates ignored the police notice and continued constructing a permanent structure on the disputed property, covering a drainage channel through which water from his house flows.

The construction has reportedly intensified tensions between the two sides, despite the court`s intervention.

Denying the allegations, Sumon`s mother, Nasima Akter Rupa, said her family had been living on the property for a long time after building their home there.

She alleged that Abdur Razzak was harassing them by making an unlawful claim over the land and filing a false case in court.

Contacted over the matter, Assistant Sub-Inspector (ASI) Akter Hossain of Shibganj Police Station said police had visited the site and instructed those involved to stop the construction work.

He added that the police were taking steps to ensure that the situation did not deteriorate or lead to any breach of law and order.

The dispute has once again highlighted the importance of respecting court orders and resolving land-related conflicts through lawful means rather than taking matters into one`s own hands.
